depends on what you mean by "good" tbh! I go into this in the piece, but for the purposes of the Court of Arbitration for Sport judges, Thomas had to prove that she herself was being discriminated against by the policies she was challenging; they ruled that because she hadn't competed in events that would qualify her for international "Elite" events, the policies she was challenging never "triggered" against her. In essence, they were saying she couldn't sue just because she believed the rules were discriminatory -- she needed to get to the point where they were actively discriminating against her, specifically, to have standing for a case.

i am not a lawyer myself and can't really speak to how valid/justifiable this decision is, but imo it does suck! this is also the legal body that (in 2019) ruled medically discriminating against Caster Semenya based on her hormone levels was okay actually, because it was a "necessary, reasonable and proportionate means of [...] preserving the integrity of female athletics". semenya has basically spent the last five years appealing that and has basically said at this point her competitive career is over, she's just doing it for younger intersex athletes.
