if ubisoft is teaching you "you do not actually OWN the game you bought" by not patching online-only games to work offline, then nintendo is teaching people "you are a criminal for even playing our games" through a fucked up abusive relationship with the public. and either way this solidifies the precedent that under USA legislation for software, you have no rights.

i could try to make a whole longpost about how i feel about this bullshit, or i could point people to the videos that Ross from Accursed Farms has been making about The Crew being shut down and how he is trying his damn best to use this as a front to push back against game companies *at least a little bit.*

this whole thing he is trying to do is running off of what he discussed in his original video titled "Games as a Service" is fraud, and while this video is very good, its less important than what gets brought up later in his videos about The Crew. the first video is called Dead Game News: The Crew and it goes over the situation with the game, as well as a bunch of brainstorming for how to send some kind of message to Ubisoft that this is bullshit actually. and you can tell that Ross is intent on carrying out not just "a plan," but carrying out "a plan that has a chance of working."

the first video is more of a call for help for how to go about this. the second video, which is the one that i embeded at the top of this post, is the scarier video.

a man named "Martin the Florida Lawyer" found Ross's video on The Crew and reached out to Ross. he wanted to give a hand in this, for free, cause this guy is also on the exact same page as Ross, being described as "personally motivated" in this situation. what this lawyer was able to research is that there was already a lawsuit in the 90s about what software is or is not allowed to do. the lawsuit is ProCD, Inc. v. Zeidenberg. nobody knows about this lawsuit, or at least its not a household name by any stretch, because the only other time it was brought up to Ross after his call for help was as a citation in another legal paper.

long story short, this lawsuit established that software is exempt from consumer protection laws, as long as they have an EULA that the user agrees to.

in 1996.

in Ross's words, this is kinda like restricting air travel laws before the balloon was invented.

this is why these companies can get away with being absolute fucking shitheads all the time. its in USA legislation. as far as the law is concerned, you have to fucking do what discord tells you to do or else you are a felon. you are not allowed to say "hey isnt this kinda impeding on my rights?" software is not controlled by consumer protection laws. its controlled by the EULA that you get roofied with, and you cant say shit about it.

this is all only tangentially related to whatever the fuck nintendo is doing, but its really further cementing that the way digital stuff is handled in the united states is like literlaly nowhere fucking else on the planet. as Martin put it, "It is only videogames where you have this hyper level of anti-consumerism." nintendo isnt trying to protect their consoles here. they are trying to scare the shit outta people. they dont want you to play their games. they dont want you to enjoy their product. they want you to buy their products and keep you held tightly inside their ecosystem.

and it goes beyond that because nintendo also fucking took down citra aparently. citra is the only 3ds emulator. this is for the 3ds. they are shutting down support for the 3ds THIS MONTH. and they still took down citra. this makes no sense, other than terrorism.

someone else posted that nintendo knows what they are doing cant be done through court. they know a judge would throw out the case because yuzu and citra made these emulators without stealing any code from nintendo. they are actively settling these cases out of court because a court would not be on nintendos side.


again these videos i linked are only tangentially related to the current situation with nintendo, but they are still worth a watch. the Dead Games News videos are both really good to watch because they dont just go over ethical concerns for why what games are doing right now are bad, but the curtains have been pulled back as to how absolutely fucked up the situation is in general in the USA.

and hey, Ross is doing good work here. it seems like he actually may have a plan to stick it to Ubisoft. long story short, USA is useless. if you live anywhere else, you can help complain about The Crew getting shut down, and you may be able to send a message to other companies in the future as well. so go watch these videos if you are interested in saving some aspect of gaming, because i am so shit at explaining things and Ross has put everything very clearly.
