never forget that draconian forever-copyright is a corporate corruption of the original concept of copyright: to grant authors a time-limited monopoly on their own work in order to make the arts a viable way to make a living, back in the age when you'd license your work to a company with a printing press and not want to compete with some other printing press's unauthorized copies of your own work undercutting you. there's nothing natural about a world where the characters and media we and our parents grew up with aren't ours to remix by now.

But, you see -- I should preface this by noting I'm being EXTREMELY sarcastic here, if it's not clear already -- the trouble is the Rhythm Studio devs were actually doing something with the Rhythm Heaven IP, and Nintendo's terribly afraid of things Being Done with their inactive franchises.
