Would highly recommend switching to a less predatory bank if you have the means. Ally Bank works pretty well for me and you have to try your damnedest to even get overdraft fees.
Also, did they charge it in a way that maximized the amount of overdraft fees they could charge? What bank was it?
It sounds like they may have hit you with the big charges first to push you under, which... Is definitely illegal.
I'll have to review the order of charges, but I didn't see any order to them. I'll look into that bank! My old bank is a credit union back in florida and frankly I need to sever any ties i have back to there.
No problem! I've been screwed over by banks before and am happy to help people avoid the same fate.
It seems that the law I was thinking of is based on some state laws (not in florida sadly) and is a federal bill that has been, of course, sitting in congress for years collecting dust. So while reordering is not yet illegal in all states, it definitely sucks.
Also, $40 is literally the highest overdraft fee I've ever seen, lord. All the articles I read mentioned something like "Up to $30-35" too. I'd bail from that credit union ASAP before they steal more from you.

If any of those charges were the same place trying and failing to charge you twice, this looks like a good class-action lawsuit to toss your hat in with as well.
