It's mildly annoying how the US Constitution doesn't actually seem to spell out which rights are(n't) absolute, and how that works, within its own text?
Like, Canada is really straightforward on the rights front β the "reasonable limits" and "notwithstanding" clauses, and that's the basis right there. Sure, the former relies on the Oakes test to give it its substance, to a large extent, but the mechanism is at least on its face right there. The obscenity or whatever exceptions to the First Amendment, though, like,
it's no wonder laypersons sometimes get the impression US constitutional rights are absolute.
