Have you contacted staff recently about the TOS loophole you blogged about however long ago? I know it’s lowish priority for them because copyright law can be so technical that it’s better to contact a copyright lawyer and essentially have them draft it. It’s just that in light of the funding issues, a part of me can’t help but see this as a necessary precaution.
