I'm pretty sure there are a few apes that are, like, actually registered trademarks owned by the creators of the NFT that they lease out through more traditional avenues. The owners of the BAYC brand are capitalists who crave legitimacy and want to do actual collaborations with with established brands.
For every tech bro who's got a SICK idea for a crypto themed burger barn and is willing to put up with blockchain bullshit there's gotta be at least one Anheuser-Busch marketing exec who's gonna tell them to go fuck themselves if they won't sign a standard contract. So my guess is that these apes are actually trademarked like normal brand mascots, in the way that a lot of DAOs are actually legally LLCs with owners rather than actually decentralized voting blocks. For all their talk of decentralization these guys just want to make money, and that's going to take precedent.
