TLDR: there’s a case at the 9th circuit court right now, and San Francisco is asking them to lift an injunction that prevents the City from stealing and destroying the belongings of unhoused people. In case that was too many multiple negatives, the City is continually violating the human rights of unhoused people, and they are asking the court to allow them to continue that.

There’s a rally right now at the courthouse in San Francisco where there are a bunch of reactionaries and right wing gross people who also want the human rights violations to continue. There’s also a bunch of us counter protesters who support the injunction and the lawsuit that triggered it.

Based on the Twitter thread linked above, it doesn’t sound like the case is going well for the City, but we will see if the injunction is lifted or not.

CalTrans I think pretty solidly lost the exact same case previously1, so presumably the law is not on their side. Of course that doesn't stop them from doing it. Same with City of Oakland when it's park land and presumably most other local jurisdictions.


  1. A lot of encampments end up being on land that is owned by the state and controlled by CalTrans, even though it's in the middle of our cities, because the land as associated with either the highway system or train tracks or both.
