So, when we last left the slow motion train wreck that was Justin's attempts to sue Tenkar for defamation - his lawyer had been schooled by the judge for having completely misinterpreted the court rules and basically moving to try to deny the right for a pre-motion for dismissal via crying it was "too late" when it was not too late, and also it was size pages over the length limit and addressed none of the merits of the motion.
Apparently the one bit of feedback that Bernie took away from that was that he should edit it down to three pages... and he did that, and the judge (predictably) issued a same day decision that she did not care for his nonsense and has not changed her opinion on what the rules of her court are.
It clearly did not go well.
90% of Law is administration, anything you want to say in court you're supposed to have said in writing in advance and there is an expectation of some degree of finality. By failing to address any of the merits of the motion, Bernie has put himself on the back foot to combat it at the hearing.
The hearing itself is scheduled for 6 January 2023... so we'll all have to wait in eager anticipation to the clown show progresses.
