Last time the Victim Jim Williams, and Killer John Smith were last seen together was when John publically screamed in a bar said he "Would kill his entire family in a week, I just gotta get a gun from pappas" A few days later John's father sent a notice to the police that his shotgun had dissapeared. The day of the crime he was caught with no registration for the shotgun while being stopped for drunk driving, His statement at the time was "I was out hunting with my Dad's shotgun and had a couple of beers officer, it won't happen again" on which he was let off with only a warning.

This evidence only came to light 4 years after the case was closed in 1994 because Bill Johnson, the policeman that stopped John that day, had a bad habit of not disclosing full records of the people he routinarily stopped if they didn't do anything illegal, he was laid off the force in 1987 over this habit.

John was stopped 3 days before the crime by a Gun Shop owner after he tried to buy shells too big for his shotgun, with the premise that if he needed help on buying the correct ammo, according to the shop owner's testimony John said "he wanted to buy anything that would kill a man" before correcting his sentence and adding "for self defense" The day of the crime the Gun Shop owner gave the police this tip but they said it will be archived later due to the media presence of the case. This evidence was recently found in 2008 after an archive clearance of the Police department, and found in a folder titled "Fame chasing fairytales"
