Bloomberg (archive.is link), last week, dropped a major new update in Trader Joe's efforts to bust independent labor union Trader Joe's United: arguing that the NLRB is wholly unconstitutional. This comes after Trader Joe's was laughed out of court for an attempted trademark lawsuit against the union.

Via FOIA, Bloomberg News was able to acquire a transcript of a January 16th NLRB proceeding at which this argument was made. They write that:

At a Jan. 16 National Labor Relations Board hearing in Connecticut, an attorney for Trader Joe’s told the judge considering union-busting allegations against it that the company wished to introduce a new argument in its defense.]

“The structure and organization of the National Labor Relations Board and the agency’s administrative law judges is unconstitutional,”

But Trader Joe's is, as their headline notes, not the only company currently attacking the constitutional legitimacy of the NLRB. Noted enemy of organized labor Elon Musk is also levying a similar legal case against the NLRB through SpaceX, which is currently being pursued by the NLRB for its illegal firing of employees. Obviously, either case succeeding would be catastrophic for organized labor—and these companies should, accordingly, draw nothing less than your absolute scorn. They're a vanguard leading the corporate charge for unchallenged ability to exploit and abuse workers and should be spoken of only with contempt.
