no, because that's an ill-defined concept that nobody will agree on the meaning of. i think they willingly made a choice they easily and absolutely could have not chosen, and the outcome of that choice was completely forseeable and extremely likely
and like, literally, who could have stopped them? the people whose safety regulations and recommendations they explicitly ignored and disdained?
