EDIT: okay so the issue with this is not performance, it's that the top div does not let touch events through once you give it a z-index (this is necessary for my css crime) so now it becomes and issue of getting touch events through a z-indexed div, which I thought pointer-events: none; touch-action: none; would solve but it does not....
